Development Agreements

 
  • During a large-scale annexation process in 2007 and 2008, the City worked with 154 different properties that are subject to non-annexation 12-year term development agreements with the City that expire on June 2, 2020.
  • On May 7, 2020 City Council approved a resolution to move forward with the annexation process or to renegotiate the development agreements to defer annexation at least another 5 years for these 154 properties.
  • The May 7th action did not begin a new annexation process; rather, it was the final step in a process that was begun, and agreed to by all parties, twelve years ago. However, Council fully intends to offer each property owner the opportunity to enter into a new development agreement that will extend the non-annexation time period several more years into the future.
  • The city will not complete the voluntary annexation process until after a property owner has had the opportunity to enter into a new development agreement.  A new development agreement would extend the non-annexation time period several more years into the future.
    • If a property owner chooses not to enter into a new development agreement, or fails to communicate with the City about their desires, then the City will proceed with the voluntary annexation.  At that time, public hearings would be required, and will be held by the Council. 
  • If a property owner chooses to extend the non-annexation time period, it is not necessary to execute the new agreement before the original one expires because it is a new, independent agreement rather than an extension of the original. Once the new agreement is executed, the City will terminate the voluntary annexation process.

Next Steps 

  • The City (Planning and Development Department) will continue to stay in contact with the property owners of the current development agreements to get their input, answer questions and to communicate the next steps in the process.
